Unfair Competition and False Advertising

False advertising means advertising something which is not true about the product. It can also be used by a competitor to advertise something false about the other product owner in competition. Section 43(a) of the Lanham Act which is also known as a trademark statute or law in USA gives protection to businesses against the unfair competition of misleading advertising or labeling. An injunction can be obtained against the false advertisement which is being used by the competitor to mislead the consumers. damages can also be claimed.
